1 Introduction

These Terms & Conditions ("Terms") govern your use of Monitrova, a website monitoring service operated by Wayne Tomlinson (registered at Partida Benicolada 1-N, 03710 Calpe, Alicante, Spain; Spanish NIE ESY6523555X) — referred to below as "we", "us", "our". By creating an account or using the service, you agree to these Terms in full.

If you do not agree with any part of these Terms, you should not use Monitrova. If you have questions, contact us before signing up.

These Terms should be read alongside our Privacy Policy, which explains how we handle your personal data.

To keep the rest of this document clear, here is what we mean by key terms:

Monitrova is a tool that sends automated HTTP requests to website URLs on your behalf to check their availability, SSL certificate status, and homepage health.

4 Your responsibilities

Important: You must only add websites to Monitrova that you own or have been explicitly authorised to monitor. Do not add websites belonging to others without their permission.

5 Monitoring limitations

Please read this section carefully. Monitrova is a monitoring tool, not a guarantee. There are inherent limitations to any automated monitoring system that you should understand before relying on alerts for critical operations.

Checks are periodic, not continuous. Monitrova checks your sites at set intervals (depending on your plan — every 1 to 5 minutes for uptime checks). A problem that appears and resolves between checks may not be detected. There is always a window between when a problem starts and when the next check runs.

Alerts may be delayed. After a failed check is detected, there may be a short delay before the alert email is sent and delivered. Email delivery is handled by a third-party provider and is subject to internet routing and your email provider's processing time. We cannot guarantee instantaneous delivery.

False positives and false negatives can occur. Temporary network issues between our servers and your site, brief DNS hiccups, or transient server errors may cause a failed check that does not reflect a real problem (false positive). Conversely, a problem that affects only certain network paths may not be detected by our checks (false negative). We do not check from multiple global locations.

SSL and SEO checks have their own limitations. SSL checks inspect the publicly visible certificate on your domain. SEO checks fetch and analyse your homepage HTML. Both depend on your site being reachable at the time of the check. Changes to your site's structure, server configuration, or third-party dependencies may affect the accuracy of these checks.

We are not responsible for outages you are not alerted about. By using Monitrova, you acknowledge these limitations and agree that we cannot be held liable for losses arising from a missed, delayed, or inaccurate alert. See Limitation of liability for full details.

6 Accounts & security

You are responsible for all activity on your account. If you believe your account has been compromised, change your password immediately and contact us.

We reserve the right to suspend or terminate accounts that show signs of unauthorised access, abuse, or violation of these Terms. We will attempt to notify you before taking action unless the situation requires immediate suspension to protect the service or other users.

Each account is for use by a single individual or organisation. You may not share your login credentials with others.

7 Billing & subscriptions

Monitrova offers a free plan and paid subscription plans. Paid subscriptions are billed in advance on a monthly basis through Stripe, our payment processor. All prices are shown in EUR (€) and are inclusive of any applicable taxes unless stated otherwise.

By subscribing to a paid plan, you authorise Stripe to charge your payment method on a recurring basis at the then-current plan price. Your subscription renews automatically at the end of each billing period unless cancelled beforehand.

You can upgrade or downgrade your plan at any time from within the app. Plan changes take effect at the start of the next billing period unless otherwise indicated. Downgrading to a plan with a lower site limit will not automatically remove your monitored sites, but checks will be paused for sites that exceed your new plan's limit until you reduce the number of active monitored sites.

If a payment fails, we will notify you by email and retry the charge. If payment remains outstanding after a reasonable period, your account may be downgraded to the free plan or suspended until the balance is settled.

8 Cancellations & refunds

You can cancel your subscription at any time from the billing section of your account. Cancellation stops future charges. Your paid plan remains active until the end of the current billing period, after which your account reverts to the free plan.

We do not offer refunds for partial billing periods or unused time remaining on a subscription, except where required by applicable consumer protection law. If you believe you have been charged in error, contact us at hello​@monitrova.com and we will review your case promptly.

If you are an EU consumer, you have a statutory right of withdrawal within 14 days of your initial purchase, provided you have not yet made use of the paid features. If you have used the service during that period, the right of withdrawal may not apply. Contact us to discuss your specific situation.

9 Acceptable use

You must not use Monitrova to:

10 Service availability

We aim to keep Monitrova running reliably, but we do not guarantee uninterrupted availability. Scheduled maintenance, unexpected technical issues, or factors outside our control (such as hosting provider incidents, network outages, or third-party service failures) may cause temporary interruptions.

We do not publish a formal SLA (Service Level Agreement) for any plan. If the service is unavailable for an extended period and you have a paid subscription, contact us and we will consider a reasonable credit at our discretion.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. Where possible, we will give reasonable advance notice of significant changes that affect paid subscribers.

11 Limitation of liability

To the fullest extent permitted by law, Monitrova and its operators shall not be liable for:

Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the total amount you have paid to us in the three months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

12 Termination

You may close your account at any time from your account settings. This cancels your subscription and, upon request, triggers deletion of your data in accordance with our Privacy Policy.

We may suspend or terminate your account if you breach these Terms, fail to pay for a subscription, or use the service in a way that is harmful to others or to the infrastructure. Where reasonable, we will notify you before taking action and give you an opportunity to resolve the issue.

On termination, your access to the service ceases. Sections of these Terms that by their nature should survive termination — including limitations of liability and any outstanding payment obligations — will continue to apply.

13 Changes to these terms

We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent version.

If we make a material change — one that significantly affects your rights or obligations — we will notify you by email at least 14 days before the change takes effect. Minor clarifications may be made without advance notice.

Your continued use of the Service after any update constitutes acceptance of the revised Terms. If you do not agree with a change, you should cancel your account before the change takes effect.

14 Governing law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

If you are a consumer resident in the EU, you also benefit from any mandatory consumer protection provisions in force in your country of residence, which these Terms do not override.

Any dispute arising out of or in connection with these Terms shall first be addressed by contacting us at hello​@monitrova.com. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Alicante, Spain.
